Terms and Conditions for Supaloo – Portaloo Hire & Suck-and-Service Operations


1. Definitions

1.1 "Supaloo", "we", "us" refers to Supaloo Limited.
1.2 "Customer", "you" refers to the party hiring equipment or services.
1.3 "Equipment" includes all portaloo units (ground, trailer, single, double, quad, accessible) and associated hire items.


2. General Terms

2.1 These terms govern all portaloo hire and waste removal services provided by Supaloo.
2.2 By making a booking, you agree to be bound by these terms.
2.3 We reserve the right to amend these terms at any time by providing notice on our website.


3. Hire Period & Delivery

3.1 The hire period commences upon delivery and ends when we collect the equipment.
3.2 You must:

  • Provide safe, unobstructed access for delivery/collection

  • Ensure the site is level and stable

  • Obtain any necessary permits or approvals
    3.3 Delivery fees will apply as specified at time of booking.


4. Equipment Use & Responsibilities

4.1 You must:

  • Use equipment only for its intended purpose

  • Not modify, relocate or interfere with equipment without our consent

  • Keep units secure and prevent unauthorized use
    4.2 You are fully responsible for:

  • Any damage, loss or theft during the hire period

  • Consequences of improper use or installation
    4.3 Report any issues or defects immediately.


5. Servicing & Maintenance

5.1 For long-term hires:

  • Regular servicing will be provided at agreed intervals

  • Includes waste removal, cleaning and restocking
    5.2 Additional servicing available upon request (fees apply).


6. Fees & Payment

6.1 Hire charges:

  • Calculated based on hire period and equipment type

  • Minimum charges may apply for short-term hires
    6.2 Payment terms:

  • Invoices issued monthly/on completion

  • Payment due within [X] days via bank transfer
    6.3 Late payments:

  • Interest charged at 2% per month

  • Debt recovery costs payable on overdue accounts


7. Liability & Insurance

7.1 Our liability is limited to:

  • Direct costs of the services provided

  • Rectification of our negligent work
    7.2 We are not liable for:

  • Consequential or indirect losses

  • Damage caused by your misuse or third parties
    7.3 You must:

  • Maintain adequate insurance coverage

  • Pay any insurance excess (minimum $500 + GST)


8. Damage & Loss

8.1 You are responsible for:

  • Repairing damaged equipment to original condition

  • Replacing lost or irreparably damaged items
    8.2 Charges will include:

  • Repair/replacement costs

  • Loss of hire revenue (capped at 120 days)


9. Termination & Cancellation

9.1 We may terminate hire if:

  • You breach these terms

  • Safety concerns arise

  • Payment is overdue
    9.2 Cancellation by you:

  • Event hires: Cancellation fees may apply (to be specified per booking)

  • Standard hires: [X] days notice required
    9.3 Early termination:

  • No refunds for unused hire periods unless agreed


10. Force Majeure

Neither party is liable for delays or failures caused by:

  • Natural disasters

  • Government actions

  • Labor disputes

  • Other events beyond reasonable control


11. Miscellaneous

11.1 These terms constitute the entire agreement.
11.2 No waiver of any breach affects our other rights.
11.3 Unenforceable provisions will be severed.


12. Governing Law

12.1 These terms are governed by NZ law.
12.2 Disputes will be resolved in NZ courts.
